Terms and Conditions For All Sales At Pacific Sun systems
**All prices quoted are based on 100% payment at the time of purchase. We welcome and will assist in company research for credibility and worthiness, for the consumer's protection. Any payment or layaway payment plans will incur an additional fee. Prices shall be valid for the term noted on quote or invoice, with no other implied discounts unless noted by the seller. The seller shall not be responsible for any costs resulting from Buyer-caused delays and or changes
There is a 33% restocking fee on all cancelled or unfulfilled orders. All Sales are final.
SHIPPING IS A NON-REFUNDABLE LINE ITEM ON CANCELED ORDERS. General Conditions of Order All quotes or sales are based on our understanding of agreed specifications only, which are documented in our quotation, spec sheets and website. Any other specification sections may or may not comply. Shipment price is F.O.B. jobsite on truck curbside. Offloading and placement of the goods shall be solely your responsibility.
1. Maintenance and Service Calls are not included with any sale unless specified. Your item likely has a factory warranty in which the manufacturer will have to be contacted directly for. If you need help finding your closest local service point or tech, please contact us via email. 2. Pacific Sun systems will assist in provide information as may be necessary for the acquisition of permits and licenses. However, Pacific Sun systems is not a permit consultant or legal firm, and cannot obtain any licensing for any customer. IT IS UP TO YOU, THE BUYER, TO OBTAIN KNOWLEDGE OR INFORMATION THAT PERTAINS TO LOCAL ENVIRONMENTAL , TECHNICAL, NOISE AND VISIBILITY REGULATIONS! While we will provide our best attempt at all requested factory material and information, the LIABILITY IS NOT-ON Pacific Sun systems
TERMS OF THE SALE Unless otherwise specifically stated, payment terms are based on the date of invoice, NOT DELIVERY. Custom Orders ALWAYS REQUIRE a deposit. All additional delivery fees, sales or use taxes, any type of property tax or any manufacturer's or other excise tax levied by federal, state or municipal government or any sub-division thereof, are the liability of the purchaser and if paid by the seller are rechargeable to the purchaser. All sales are subject to the approval of our credit department. This and all subsequent purchases are payable to Pacific Sun systems located in City of Las Vegas, NV with Sales Office in San Diego, CA. Pacific Sun systems reserves the right to cancel this contract and minimally collect a 33% restocking and/or cancellation fee as noted above, upon any of the following:
1. Breach of contract by the purchaser.
2. Failure by purchaser to make payments as required.
3. Insolvency or bankruptcy: The seller may cancel an order if the purchaser does not have the ability to pay.
4. Disappearance, skipping and/or a lack of communication over 31 days regarding a placed order.
No terms contained in the purchaser's purchase order, shipping request or other communications shall vary the terms and conditions of this agreement, expressed herein, whether or not shipment of the goods followed receipt of such purchase order or any other communication.
ACCEPTANCE All quotations are subject to prompt acceptance and transmittal of order. Prices are subject to change without notice unless otherwise stated. All prices are valid for 30 days from documented date. Contracts and agreements are not valid unless approved and accepted in writing in the corporate office in CA. All contracts shall be deemed to have been executed in California. CANCELLATIONS Orders cannot be scheduled, cancelled, specifications changed or goods returned without seller's prior permission. Acceptance is conditional upon reimbursement for consequential loss to the seller. A 33% restocking fee will be charged for any and all cancelled orders.
FACTORY ORDER POLICY Orders will be placed with the Factory when any of the following occur: verbally agreement, agreement via email, official purchase order via email, signed or not. Your remittance acts as an agreement to do business and should be taken seriously. Pacific Sun systems reserves the right to pursue any losses, damages or overhead directly related to planning, developing or configuring. It is the buyer's responsibility to notify Pacific Sun systems as soon as possible of any changes to any form of agreement that leads to planning, developing or configuring. Free consulting is not included and should never be expected. All prices are listed on Pacific Sun systems . If you are unsure about the nature of your needs, it is the buyer's responsibility to notify Pacific Sun systems as soon as possible. Even then, this notification does not eliminate the buyer from fees related to planning, developing or configuring. As of 3/11/2012 there will be a mandatory minimum fee of $500 per day for all power, wind and/or solar systems quoting, planning, developing or configuring. This minimum $500 fee is applicable to any day in which documented time was spent quoting, planning, developing or configuring any power, wind or solar system under 10KW. For systems over 10KW that fee is $1,000 per day. (Please remember this takes time, and if you are not serious, be courteous of others time. We should not be considered unpaid wind or solar consultants at any time. We do not owe any of you our time.)
WARRANTIES The seller's liability is limited to making good defects in workmanship or material under the manufacturer's warranty and shall not exceed the purchase price of the defective item. The seller in no event shall be liable for damages to persons or property arising out of the use of items sold. This warranty supersedes all prior assurances, written or oral made by the seller, its agents or representatives. CREDITS (added 2/13/2014 any store credit depreciates daily. You may apply your credit, as applicable, to the registration of another sales. Any credits not applied to another sale will continue to depreciate on a daily basis over the course of the remaining period of validity. WARNINGS: Pacific Sun systems always acts upon it's duty to warn the consumer that any equipment, especially power generation equipment is to be mounted, installed, stored and located away from dangerous conditions at all times. Dangerous conditions include, but are not limited to: high or low temperature areas, areas near open sparks or flammable materials within the safety zone of any part of the item, wet or places subject to water or wetness. Modifications to the delivered item in any way, are the responsibility of the buyer. We caution all buyers to use common sense, and take the utmost caution when modifying and installing any product. It is up to the buyer to ask for any required specifications needed by opinion or LAW. UL and/or similar certifications are NOT required by law in most places. However ANY AND ALL codes in the buyers location of purchase OR installation, are the duty and responsibility of the buyer. It is Pacific Sun systems WILL NEVER APPROVE THE INSTALLATION BY A NON CERTIFIED TECHNICIAN. IT IS OUR DUTY TO DEMAND THAT A CERTIFIED TECHNICIAN WITH PROJECT-SPECIFIC EXPERIENCE PLAN AND DEPLOY ANY INSTALLATION RELATED DUTIES.
PERFORMANCES Information provided concerning performance of equipment listed hereon are engineering estimates only and no guarantee to meet such specifications is to be implied.
CONFIDENTIAL INFORMATION This proposal as well as all information therein, including prints, brochures, intellectual property, contacts, prices, designs, vendor information, all of such which are to be considered confidential and property of Pacific Sun systems ANY information should be considered as intended only for a purchaser's use and are not to be used in any way detrimental (mentioned or otherwise) to the seller. This section of policy, but not limited to this section, are to be considered and implied as a Non-Compete Agreement and Non-Disclosure Agreement. Any infraction of said policies will be immediately subject to a design and consulting fee of $7,500 minimally may be applied.Pacific Sun systems operates under laws of San Diego County, CA and/or Clark County, NV.
DELIVERIES Approximate lead time for generators is an industry standard 3-8 weeks. All generators are new, and built to order upon custom specifications. Promises of delivery are given as accurately as conditions will permit, but seller DOES NOT guarantee to accomplish shipments on date or dates mentioned. It is up to the buyer to arrange for delivery, unless noted, all prices are to-the-curb shipping, meaning extra fees will be charged for liftgates, or moving equipment. THIS IS NOT THE RESPONSIBILITY OR AREA OF EXPERTISE OF Pacific Sun systems
DELAYS Deliveries under all contracts and agreements are contingent upon acts of providence, strikes, accidents, governmental priority regulations and other causes of delay beyond the seller's control, and in no event will the seller by liable for consequential delays or losses. DISPUTES In the event of a dispute, concerning any or all of the terms of this agreement, the full cost of legal process including attorney’s fees shall be borne by the party against whom judgment is rendered in a court of law.
This Warranty gives you specific legal rights, and you may also have other rights that vary by country or from state to state.
PROCEDURE FOR MAKING A WARRANTY CLAIM For any defect covered by this Warranty, contact any authorized Pacific Sun systems distributor or dealer to obtain the name, address, and telephone number of the nearest AUTHORIZED Service and Repair Facility within thirty (30) days of the discovery of such defect(s).
WARRANTY PERIOD The Warranty Period begins on the date of delivery to the original retail purchaser. The following table lists the warranted duration or total operation hours for each power generator engine and/or associated product(s).
WHAT IS NOT COVERED BY THIS WARRANTY This Warranty does not cover parts affected, damaged, or depreciated by misuse, abuse, improper maintenance, neglect, use of unsuitable attachments or no genuine parts, ordinary wear, rust or corrosion, inadequate transportation, accident, or service by an unauthorized facility.This Warranty does not cover alterations by the customer, or any party other than an authorized tech.
Consumable parts, such as filters, belts, gaskets, packing, fuses, brushes, fuel injection nozzle valve, lubricant, protective zinc coat, thermostat and ignition plug, are not covered under this warranty. All expenses incurred in maintaining and replacing them shall fall on the purchaser.
This Warranty does not obligate Pacific Sun systems to bear any fees for transportation of any item to and from the place designated for Warranty Service.
Pacific Sun systems MAKES NO OTHER EXPRESS WARRANTIES OTHER THAN SET FORTH ABOVE, AND ALL OTHER OBLIGATIONS OR LIABILITIES, INCLUDING SPECIAL OR CONSEQUENTIAL DAMAGES OR CONTINGENT LIABILITIES ARISING OUT OF THE FAILURE OF ANY ENGINE/PRODUCT TO OPERATE PROPERLY, ARE HEREBY EXCLUDED.
No person is authorized to give any other Warranty or to assume any additional obligation on Pacific Sun Systems behalf.
Some states or countries do not allow the exclusion or limitation of incidental or consequential or special damages, so the above limitation or exclusion may not apply to you.
